1. Acceptance of Terms

Welcome to JobsManager ("Company," "we," "our," or "us"). By accessing or using our website, mobile application, or any services provided by JobsManager (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

Important: These Terms contain important information about your rights and obligations, including limitations of liability and dispute resolution provisions. Please read them carefully.

By creating an account or using the Platform, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Definitions

  • "Job Seeker" means an individual who uses the Platform to search for, view, and apply for job opportunities.
  • "Employer" means an individual, company, or organization that uses the Platform to post job listings, search for candidates, and manage applications.
  • "User" refers collectively to Job Seekers, Employers, and any other individuals or entities using the Platform.
  • "Content" means any information, text, graphics, photos, profiles, resumes, job listings, messages, or other materials uploaded, posted, or transmitted through the Platform.
  • "Platform" means the JobsManager website, mobile applications, and all related services and features.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Platform, you must create an account. When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Types

JobsManager offers two types of user accounts:

  • Job Seeker Account: Free account allowing you to search for jobs, create a profile, upload resumes, apply for positions, and receive job alerts.
  • Employer Account: Account allowing you to post job listings, manage applications, search for candidates, and access recruitment analytics. Fees may apply for certain features.

3.3 Account Security

You are responsible for:

  • Keeping your password secure and confidential
  • Not sharing your account credentials with others
  • Immediately notifying us of any unauthorized use of your account
  • Ensuring that you log out of your account at the end of each session

We are not liable for any loss or damage arising from your failure to comply with these security obligations.

Security Alert: JobsManager will NEVER ask for your password via email, phone, or text message. If you receive such a request, please report it to us immediately.

4. Job Seeker Terms

4.1 Profile and Resume

As a Job Seeker, you may create a profile and upload your resume/CV. You represent and warrant that all information in your profile and resume is accurate, truthful, and not misleading. You are solely responsible for the content of your profile and any communications with employers.

4.2 Applying for Jobs

  • You may apply for jobs posted on the Platform through the provided application process.
  • Your application materials (including cover letters and resume) will be shared with the employer.
  • We do not guarantee that you will receive responses from employers or that any job listing will lead to employment.
  • You are responsible for verifying the legitimacy of job postings and employers.

4.3 Job Alerts

You may opt-in to receive job alert notifications via email or SMS. You can manage these preferences in your account settings and unsubscribe at any time.

4.4 Your Responsibilities

  • Provide accurate and truthful information in your profile and applications
  • Respect employer confidentiality and privacy
  • Not use the Platform to engage in any fraudulent or misleading activities
  • Not apply for jobs you are not qualified for or genuinely interested in

5. Employer Terms

5.1 Job Postings

As an Employer, you may post job listings on the Platform. By posting a job, you represent and warrant that:

  • The job posting is accurate, truthful, and not misleading
  • The position is genuine and currently available
  • You have the authority to hire for the position
  • The job posting complies with all applicable laws and regulations
  • You will not discriminate against applicants based on race, color, religion, gender, sexual orientation, national origin, age, disability, or any other protected characteristic

5.2 Review of Applications

Employers agree to:

  • Review applications in a timely manner
  • Respect applicant privacy and confidentiality
  • Not use applicant information for purposes other than evaluating their candidacy
  • Comply with all applicable data protection laws when handling applicant data

5.3 Communication with Candidates

Employers are responsible for all communications with job applicants. We recommend maintaining professional and respectful communication throughout the hiring process.

5.4 Payment Terms

Certain features for employers may require payment. By purchasing any paid services, you agree to:

  • Pay all fees and charges associated with your use of the service
  • Provide accurate and complete billing information
  • Authorize us to charge your selected payment method
  • Accept our refund policy as described on our pricing page

6. Prohibited Activities

You agree NOT to use the Platform to:

  • Post Illegal Content: Post any job listings or content that violates any applicable law or regulation
  • Discriminate: Post job listings that discriminate against protected classes
  • Harass or Stalk: Harass, intimidate, or stalk any user of the Platform
  • Impersonate: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Spam: Send unsolicited communications, spam, or bulk messages
  • Scrape Data: Use automated means to scrape, crawl, or collect data from the Platform without our permission
  • Post False Information: Post false, inaccurate, misleading, or fraudulent job listings
  • Malicious Code: Upload or transmit viruses, malware, or other malicious code
  • Interfere: Interfere with or disrupt the integrity or performance of the Platform
  • Circumvent Security: Attempt to gain unauthorized access to the Platform or its systems

Violation of these prohibitions may result in immediate termination of your account and legal action.

7. User Content

7.1 Ownership

You retain all ownership rights to the Content you post on the Platform. By posting Content, you grant JobsManager a non-exclusive, worldwide, royalty-free license to use, store, reproduce, modify, and display your Content solely for the purpose of operating and improving the Platform.

7.2 Responsibility for Content

You are solely responsible for all Content you post. We do not endorse or guarantee the accuracy, completeness, or quality of any user-posted Content.

7.3 Content Review

We reserve the right, but have no obligation, to review and moderate Content posted on the Platform. We may remove or refuse to post any Content that violates these Terms or that we determine, in our sole discretion, is objectionable.

8. Fees and Payments

8.1 Free Services

The following services are free:

  • Job Seeker account registration and profile creation
  • Job search and browsing
  • Job applications
  • Job alerts

8.2 Paid Services

The following services may require payment (see our Pricing Page for current rates):

  • Job posting packages (Bronze, Silver, Gold, Bulk)
  • Featured job listings
  • CV writing services
  • Premium employer features

8.3 Payment Terms

  • All fees are non-refundable except as required by law
  • We may change our fees at any time by posting notice on the Platform
  • Fee changes will not affect existing paid services already purchased
  • You are responsible for all taxes associated with your purchases

9. Termination

9.1 Termination by You

You may terminate your account at any time by:

  • Visiting your account settings and selecting "Close Account"
  • Contacting us at info@jobsmanagerzw.com

9.2 Termination by Us

We may suspend or terminate your account immediately without prior notice if:

  • You violate these Terms
  • We are unable to verify your information
  • Your account has been inactive for an extended period
  • Required to do so by law

9.3 Effect of Termination

Upon termination:

  • Your right to access the Platform will immediately cease
  • We may delete your account information and Content
  • Any unpaid fees remain due

10. Limitation of Liability

10.1 No Guarantee of Employment

JobsManager is a platform connecting job seekers and employers. We do not guarantee that:

  • Job seekers will find employment
  • Employers will find suitable candidates
  • Any job listing will lead to a successful hire

10.2 Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JOBSMANAGER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE PLATFORM
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
  • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions.

11.2 Dispute Resolution Process

Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at info@jobsmanagerzw.com. We will attempt to resolve the dispute through good faith negotiations within 30 days.

11.3 Arbitration

If we cannot resolve the dispute informally, you agree that any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the Arbitration Act of Zimbabwe. The arbitration shall be conducted in Harare, Zimbabwe.

11.4 Class Action Waiver

YOU AND JOBSMANAGER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
